Opt-Out: You may opt out of this arbitration agreement within 30 days of your first purchase by sending written notice to sales@contractors-tools.com with the subject line “Arbitration Opt-Out.”
IP Carve-Out: Notwithstanding the above, Contractors-Tools.com retains the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights without first engaging in arbitration.
Section 19 — Class Action Waiver
To the fullest extent permitted by law, you waive any right to bring claims as a class action, collective action, or representative proceeding. All claims must be brought on an individual basis only. This waiver applies whether the dispute is resolved by arbitration or in court.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Bowie County, Texas.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and shall not affect the validity of the remaining provisions. Our failure to enforce any provision of these Terms shall not constitute a waiver of that right.
